Default Bike Ban

Hello everyone, I have a question about speeding tickets, which I hope
hasn't been asked too many times before.

A friend of mine with a previously clean license has just been caught
speeding twice in the same day at the same place. He's looking at a total of
about 9 points, which is bad enough, but he's also had his licence less than
two years so he will lose it and have to retake the test. Also, for various
reasons he cannot do his work without his bike (busses etc won't get him
there or even close). Now I know that he was riding irresponsably etc etc
and probably deserves to lose it, so please spare the flame (i've spared you
by not making the excuses about it being a wide open stretch of road etc).
What I want to know is, is there anything he can say or do in court to
mitigate the points/ban/fine?

What are the details of the offences (speed limit / speed alleged etc) ?

what sort of road, what speed limit posted, how fast, what time of day,
what weather conditions...? etc etc etc

Depending on the above my guess is that he needs to get a brief, who can
make the claim of "needs bike for business" for him whilst he stands
looking very sorrowful.

He might get less points but the fine will go up proportionately.

The speed limit was 30. He got 3 points one way at an alleged speed of 38
mph. The other way (which was the court summons) he was alleged to be doing
54mph (yes I know that's fast) and has been told to expect 6 points. The
road is urban, but wide with little traffic and good vis.

How did you ^W he manage to miss a camera van /twice/in a 30 limit?

It think it was a camera in a van so he wasn't pulled over. I don't know who
told him to expect 6 points.

Do have a look at the faq at www.ukrm.net old chap. Pay particular
attention to the bit about not top posting (put your replies *after* the
post you're responding to) and removing .sigs (the bit after the "-- ").

Otherwise we'll have to make you resit your UKRM posting test.

it'll be interesting to see if the plod have pictures or not.
A colleage of mine got caught by a mobile van, and they had a picture of
the front end of the bike. Mr Plod noted the registration down as
colleague rode passed.

Case was dropped as soon as colleague started to argue it. Whether
that's a general rule or he was a jammy git, is unknown.

Oh - and we place our responses at the bottom round here - okay?

I think they've plugged that loophole recently. A speed reading
together with an officer's evidence of the reg. plate is enough for a
conviction.

Okay, to get a full pass, try adding the following to your skills:

Snip the original post by all means, but leave some of it to give your
reply some context.

snip the sigs of the previous post: the '--' and all that follows.

Make sure you begin your typing on a new line, so it isn't preceeded by

If all else seems likely to fail, begging forgiveness whilst sobbing may do
the trick. I would also recommend selling the bike to his wife/partner or
trusted friend for a nominal sum just before the court appearance so that he
can say without perjuring himself that he has sold the bike and has not
replaced it. It needs to be sold to someone who he can REALLY trust so that
he can buy it back again for the same price immediately after the court
appearance.

"Sold the bike, eh? Not replaced it? Clearly doesn't need a licence
then. Ban and retest. NEXT!"

If "your friend" didn't slow down to below the speed limit between the
two incidents, then it was one offence rather than two.

For the first two years of your licence you only have 6 points to play
with. That's how it was when I was on the 33bhp licence anyway, and I
assume this is the same deal.
